1. Introduction

These Terms and Conditions ("Agreement") govern your use of our services and participation in our circus school through Class4Kid. By enrolling and registering for our circus school, you agree to comply with these Terms and Conditions.

2. Enrollment

  • To enroll in our circus school, you must complete the registration process through Class4Kid, which includes providing necessary personal information, medical details, and agreeing to these Terms and Conditions.
  • All students must meet the age requirements specified in the course description to ensure they are placed in the appropriate class.
  • Your registration will be confirmed only once full payment has been received for the selected course.

3. Health and Safety

  • By enrolling in our circus school, you acknowledge and confirm that you or your child (if registering for a minor) are physically and mentally capable of participating in circus activities.
  • If your child have any existing medical conditions, injuries, or other health concerns, it is your responsibility to consult with a healthcare provider before beginning any training.
  • Participants must inform the circus school staff of any medical conditions, injuries or behavior matters prior to the commencement of any training sessions.
  • It is important to follow all instructions provided by our instructors to ensure safety during training.

4. Liability Waiver and Assumption of Risk

  • Liability: By registering for and participating in circus classes, you (or your child, if a minor) acknowledge that circus training includes physical activities that may involve a risk of injury. This includes, but is not limited to, activities involving height, acrobatics, aerial silks, trapeze, juggling, balancing, and other circus arts.
  • Assumption of Risk: You agree to assume all risks associated with participating in circus activities, including but not limited to injury or accident that may occur during training or rehearsals. You understand that these activities may require physical exertion and coordination and may involve activities at significant heights or other potentially dangerous situations.
  • Training at height:Certain circus disciplines involve training at height, such as aerial silks, trapeze, or other aerial performances. You acknowledge that these activities involve additional risks, including falls from height or equipment failure.
  • All participants in aerial or height-related activities must comply with specific safety instructions.
  • Release of Liability: While I accept that the teachers/coach(es) will take precautions to prevent accidents, I understand that GEMS Circus Arts School may not be held responsible and I accept that bruising, burns, falls from height, sprained muscles, and other injuries may occur as part of the training. You agree to release and hold harmless GEMS Circus Arts School, its staff, agents, and contractors from any claims, demands, or causes of action arising from or related to injury, loss, or damage to person or property while participating in circus classes, rehearsals, or events, whether caused by negligence or otherwise.

6. Conduct and Discipline

  • Participants are expected to maintain respect for their fellow students, instructors, and the equipment used in the circus school.
  • The circus school reserves the right to remove any student from the class if their behavior is disruptive or poses a risk to the safety of others. In such cases, no refund will be issued.

7. Photography and Video Recording

  • By attending the circus school, you consent to the possibility of being photographed or video recorded during classes and events.
  • The circus school may use such photographs and videos for promotional purposes, including on its website, social media, or printed materials, unless you provide written notice otherwise.

8. Cancellation and Refunds

  • If you wish to cancel your registration, you must notify the circus school in writing one term in advance. Refunds for cancellations are offered one term in advance.
  • The circus school reserves the right to cancel or reschedule classes due to unforeseen circumstances, and in such cases, you will be notified promptly. If a class is canceled, the circus school will offer a full refund or the option to reschedule.

9. Changes to the Terms

  • The circus school reserves the right to modify or update these Terms and Conditions at any time. You will be notified of significant changes via email or posted notices on the Class4Kid registration page. Continued participation in classes after such updates will be considered your acceptance of the updated terms.
